These Terms of Service ("Terms") govern your use of the Chaticon mobile application ("App") operated by Alfi AI Yazilim Bilgi Teknolojileri Reklamcilik Danismanlik Sanayi ve Ticaret Anonim Sirketi ("Alfi AI," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to use Chaticon. By using the App, you represent that you meet this requirement.

2. Account

You must sign in with Apple to use Chaticon. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Description of Service

Chaticon provides an interface to third-party AI language models (including but not limited to OpenAI GPT, Anthropic Claude, and Google Gemini). The App allows you to send messages and receive AI-generated responses.

Chaticon is an intermediary — we do not create, train, or control the AI models. Responses are generated by third-party AI providers.

6. User Content

You retain ownership of the messages you send through the App ("User Content"). By using the App, you grant us a limited license to process your User Content solely for the purpose of providing the Service (i.e., sending your messages to AI providers and storing conversation history).

You are solely responsible for your User Content. We are not responsible for any content you input into the App or any consequences arising from it.

7. Payments, Subscriptions & Refunds

7.1. Role of Alfi AI: Alfi AI Yazilim Bilgi Teknolojileri Reklamcilik Danismanlik Sanayi ve Ticaret Anonim Sirketi ("Alfi AI") is the company that develops the software infrastructure of the Chaticon application, ensures its technical operation, and produces in-app content and AI integrations. Alfi AI does not directly invoice end users or collect payments from them.

7.2. Merchant of Record: For all subscriptions made through the Apple App Store, the merchant of record is Apple Inc., and all payment, billing, and refund processes are governed by Apple's own terms and conditions. To cancel a subscription, the Apple ID account settings on your device must be used (Settings → Apple ID → Subscriptions).

7.3. This structure is a natural consequence of the technical and contractual operation of the Apple App Store platform, and Alfi AI does not have a direct sales relationship with the end user through this channel.

7.4. Free Tier: Certain features of the App are available at no cost, including 10 messages per day using the GPT Chat model.

7.5. Premium Features: Premium features (unlimited messages, access to all AI models) are available through a paid subscription ("Purchase") processed directly by Apple as the merchant of record.

7.6. To the maximum extent permitted by applicable laws, we may change subscription pricing at any time. We will provide you with reasonable notice of any pricing changes by publishing new prices within the App or by sending you a notification.

7.7. You authorize Apple, as the merchant of record, to charge the applicable subscription fees from your designated payment method.

7.8. Auto-Renewal: Chaticon Premium subscriptions are automatically renewing. Unless you cancel your subscription at least 24 hours before the end of the current billing period, you authorize Apple to charge you for the subsequent renewal period at the then-current rate.

7.9. Introductory Offers & Trials: The App may offer introductory pricing or trial subscriptions that provide access to Premium features for a limited time or at a reduced rate, with automatic renewal at the standard price unless cancelled before the offer period ends. We reserve the right to modify or terminate any promotional offer at our sole discretion, without notice and without any obligation.

7.10. Refunds: Purchases processed through the Apple App Store are subject to Apple's refund policies. This means that we cannot issue refunds directly when a purchase is made through the App Store. You will need to contact Apple Support or request a refund through reportaproblem.apple.com.

7.11. In accordance with applicable consumer protection regulations regarding distance sales of digital products, our digital services fall under the category of products for which the right of withdrawal may not apply once performance has begun. BY CONFIRMING YOUR PURCHASE AND BEGINNING TO USE THE PREMIUM SERVICE, you acknowledge that digital content delivery begins immediately, and to the extent permitted by applicable law, you agree that you will not be eligible for a refund except where the Service is found to be materially defective or as otherwise required by mandatory applicable law.

8. Intellectual Property

The App, its design, code, and branding are owned by Alfi AI and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

9. Third-Party Services

Chaticon relies on third-party services including OpenRouter, OpenAI, Anthropic, Google, Firebase, RevenueCat, and Meta. These services have their own terms and privacy policies. We are not responsible for the availability, performance, or policies of these third-party services.

AI model providers may change, update, or discontinue their models at any time. We may update the available models in the App without prior notice.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALFI AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Alfi AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting your account through the App's Settings page. Upon termination, all associated data will be permanently deleted.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or other means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
